Measures for the Energy Conservation Management of Public Institutions in Hunan Province


Chapter I General Provisions

Article 1 These Measures are formulated in accordance with the Energy Conservation Law of the People's Republic of China, the Regulations on Energy Conservation in Public Institutions and other laws and regulations, and in light of the actual conditions of this province, for the purpose of thoroughly practicing Xi Jinping Thought on Ecological Civilization, earnestly implementing the Regulations of the Party and Government Organs on Practicing Economy and Opposing Waste, fulfilling the work requirements of the Provincial Party Committee and the Provincial People's Government, and giving play to the exemplary role of public institutions in energy conservation across the whole society.
Article 2 These Measures shall apply to the energy conservation work of public institutions within the administrative region of this province, as well as the guidance, administration and supervision of such work, unless otherwise stipulated by laws and regulations.
For the purpose of these Measures, public institutions refer to state organs, public institutions and social organizations that use fiscal funds in whole or in part.
Article 3 People's governments at or above the county level shall strengthen leadership over the energy conservation work of public institutions, improve the management system and clarify management responsibilities. Financial departments shall, in light of actual work needs, incorporate funds related to energy conservation of public institutions into the corresponding level of budget to support energy-saving technological transformation, the popularization and application of advanced technologies and products, and ensure the effective development of energy conservation work.
Article 4 The competent department of government offices administration of the province shall, under the guidance of the provincial competent department in charge of energy conservation work, be responsible for promoting, guiding, supervising and administering the energy conservation work of public institutions across the province.
The competent departments of government offices administration of cities, autonomous prefectures, counties and urban districts shall, under the guidance of the corresponding level of competent department in charge of energy conservation work, be responsible for the supervision and administration of energy conservation work of public institutions at their own level, and guide and supervise the energy conservation work of public institutions at lower levels. Such competent departments shall appoint full-time staff to be responsible for the energy conservation work of public institutions.
The competent departments of education, science and technology, culture, health, sports and other systems shall, under the guidance of the corresponding level of competent department of government offices administration, carry out the energy conservation management work of public institutions within their own systems at the corresponding level.
Article 5 Competent departments of government offices administration at or above the county level shall, in conjunction with relevant departments, carry out publicity, education and training on energy conservation in public institutions and popularize scientific knowledge of energy conservation.
Article 6 The person in charge of a public institution shall be fully responsible for the energy conservation work of the unit.
The responsibility system for energy conservation targets and an evaluation system shall be implemented for the energy conservation work of public institutions, and the fulfillment of energy conservation targets shall be an important part of the evaluation of public institutions and their persons in charge.
Article 7 People's governments at all levels shall encourage and support public institutions to popularize and apply new energy-saving and carbon-reducing materials, products and technologies, and give play to the role of scientific research institutions, industry associations and academic groups in providing technical consulting services for the energy conservation work of public institutions.
Chapter II Energy Conservation Planning and Management
Article 8 Competent departments of government offices administration at or above the county level shall, in conjunction with relevant departments, formulate energy conservation plans for public institutions at their own level in accordance with the medium and long-term energy conservation plans of the corresponding people's governments, and decompose and implement the energy conservation targets and indicators determined in the plans to public institutions at their own level on an annual basis.
Article 9 Public institutions shall implement an energy consumption metering system, classify energy consumption types and systems, equip and improve energy metering instruments, and conduct household-based, category-based and item-based metering of energy consumption.
Article 10 Public institutions shall appoint special personnel to be responsible for the statistics of energy consumption, and submit accurate energy consumption statistics data on time. Public institutions shall regularly analyze their energy consumption status and standardize energy use behavior.
Article 11 Public institutions shall submit a report on their energy consumption status of the previous year to the corresponding level of competent department of government offices administration before March 1 each year. Competent departments of government offices administration at lower levels shall submit a report on the energy consumption status of public institutions at their own level to the competent departments at higher levels as required. Competent departments of government offices administration at all levels shall promptly organize the annual joint review of energy consumption data, regularly count and publish the energy consumption status of public institutions within their administrative regions, and strengthen the application of the results of energy consumption statistical analysis.
Article 12 Public institutions shall use energy within the quota of energy consumption, strengthen the management of energy consumption expenditure; if energy is used in excess of the quota, they shall provide an explanation to the corresponding level of competent department of government offices administration and carry out rectification in a timely manner.
Article 13 Competent departments of government offices administration at or above the county level shall, in conjunction with relevant departments, determine and regularly publish the list of key energy-using public institutions within their administrative regions based on indicators such as total energy consumption and energy consumption per unit building area. Key energy-using units shall accept energy audits and key supervision and inspection in accordance with regulations, and implement energy-saving transformation if their energy consumption fails to meet the standards.
Article 14 Competent departments of government offices administration at or above the county level shall organize public institutions to conduct carbon emission accounting in accordance with regulations, formulate and implement carbon emission control plans, and fulfill emission reduction measures.
Article 15 The government procurement supervision and administration department of the Provincial People's Government shall, in conjunction with relevant departments, timely adjust and publish the list of government procurement of energy-saving products.
Public institutions shall, in accordance with regulations, purchase energy-saving and environmental protection products included in the list of government procurement of energy-saving products and the list of government procurement of environmental label products, and shall not purchase energy-using products explicitly prohibited by the state and the province.
Article 16 Newly constructed buildings of public institutions shall meet the relevant requirements of green buildings, optimize the design of energy conservation and carbon reduction, adopt high-efficiency energy-saving and carbon-reducing equipment, and are encouraged to be constructed in accordance with the standards for ultra-low energy consumption buildings.
Eligible newly constructed buildings of public institutions shall adopt at least one renewable energy technology, and are encouraged to give priority to the application of renewable energy technologies such as solar photovoltaic and geothermal energy.
Article 17 Competent departments of government offices administration at or above the county level shall, in conjunction with relevant departments, formulate and organize the implementation of energy-saving transformation plans for existing buildings of public institutions at their own level.
It is strictly forbidden to reconstruct, expand office premises or carry out luxurious decoration in the name of energy-saving transformation.
Article 18 Competent departments of government offices administration at or above the county level shall, in conjunction with relevant departments, regularly select a certain number of high-energy-consuming public institutions for key audits based on the annual energy consumption statistics data and inspection results reported by public institutions at their own level, and order public institutions that have been listed as high-energy-consuming for two consecutive years and failed to complete the energy-saving transformation targets to carry out rectification within a time limit.
Chapter III Energy Conservation Measures
Article 19 People's governments at all levels shall accelerate the development of prefabricated buildings and actively promote prefabricated decoration.
Article 20 Public institutions shall vigorously advance e-government, implement paperless office work, reasonably control the number and scale of meetings, improve and perfect the systems of video conferences and online video conferences, and reduce energy consumption.
Article 21 Public institutions shall take the following energy conservation measures to strengthen the management of energy use:
(1) Strengthen the management of office electricity use, reduce the standby energy consumption of electrical equipment, turn off electrical equipment in a timely manner, and establish an electricity inspection system;
(2) Strictly implement the national provisions on the control of indoor temperature of air conditioners;
(3) Central heating buildings shall implement household-based metering of heating supply and charge according to heat consumption;
(4) Strengthen the operation management of self-provided heating systems, adopt advanced technologies and equipment, and improve energy utilization efficiency;
(5) Elevator systems shall implement intelligent control, reasonably set the number, floors and operating time of elevators in use, and strengthen operation regulation and maintenance;
(6) Office buildings shall make full use of natural lighting, use high-efficiency energy-saving lighting fixtures, and strictly control the external flood lighting and external decorative lighting of buildings;
(7) Conduct key monitoring of the energy use of data center computer rooms and other parts, and reduce energy consumption through effective measures such as transforming and building green data center computer rooms;
(8) Strengthen the daily inspection and regular maintenance of water supply facilities and equipment, and timely detect and correct water waste behaviors.
Article 22 Public institutions shall take the following measures to strengthen the energy conservation management of official vehicles:
(1) Implement the staffing management of official vehicles and strictly control the number of owned vehicles;
(2) Give priority to the selection of new energy vehicles for official vehicles and strictly implement the vehicle scrapping system;
(3) Strictly implement the management system for official vehicles and prohibit the use of official vehicles for non-official purposes;
(4) Regularly publish the driving mileage, fuel consumption and power consumption of vehicles.
Article 23 Public institutions shall actively popularize and apply new energy-saving products and technologies.
Public institutions shall vigorously adopt the contract energy (water) management model and entrust energy (water) conservation service institutions to conduct energy conservation diagnosis, design, financing, transformation and operation management. Competent departments of government offices administration at all levels shall actively explore the packaged trusteeship and county (city, district)-wide trusteeship models and give full play to the scale effect.
Article 24 Public institutions across the province are encouraged to make full use of suitable space such as building roofs and carport top surfaces to install photovoltaic power generation facilities with high photoelectric conversion efficiency on the premise of meeting the development conditions of distributed photovoltaic power generation.
Article 25 Make overall use of supportive and preferential policies such as venue rent reduction and exemption to attract high-quality enterprises to participate in the construction of charging infrastructure, encourage units to carry out upgrading and transformation such as transformer capacity expansion, and further promote the construction of charging piles in public institutions.
Article 26 Public institutions with canteens shall actively carry out the green transformation of canteens and popularize the use of energy-saving kitchen utensils in accordance with regulations.
Competent departments of government offices administration at or above the county level shall, in conjunction with relevant departments, actively carry out anti-food waste activities such as the "Clear Your Plate" Campaign, establish an evaluation and notification system for the effectiveness of anti-food waste work in canteens of public institutions in accordance with relevant procedures and regulations, and strengthen supervision and inspection to correct waste behaviors.
Article 27 Strengthen water conservation and protection, steadily promote the popularization and renewal of water-saving appliances, newly purchased water appliances must reach a water efficiency level of Grade 2 or above, and promote public institutions to actively utilize municipal reclaimed water.
Article 28 Competent departments of government offices administration at or above the county level shall, in conjunction with relevant departments, strengthen the management of domestic waste classification in public institutions, and supervise and guide public institutions to carry out domestic waste classification work.
Public institutions shall implement the domestic waste classification system in accordance with regulations and strengthen the collection and recycling of recyclables.
Article 29 The property service contract signed between a public institution and a property service enterprise shall specify the objectives and requirements of energy conservation management. The property service enterprise shall take energy conservation management measures in accordance with the provisions of the property service contract.
Chapter IV Supervision and Guarantee
Article 30 If a public institution causes energy waste due to non-compliance with regulations on energy use, the corresponding level of competent department of government offices administration shall issue a written opinion on energy conservation rectification, and the public institution shall implement it in a timely manner.
Article 31 When competent departments of government offices administration conduct energy conservation supervision and inspection in accordance with the law, public institutions shall cooperate, truthfully provide relevant information and materials, and shall not refuse or obstruct the inspection.
Competent departments of government offices administration shall notify relevant departments of the problems found in energy conservation supervision and inspection, and report major problems to the corresponding people's governments in a timely manner.
Article 32 The energy conservation work of public institutions shall accept social supervision. Any unit or individual has the right to report acts of energy waste by public institutions.
Competent departments of government offices administration at or above the county level shall set up a report hotline to accept reports from the public on acts of energy waste by public institutions and conduct investigations and handling in a timely manner.
Chapter V Rewards and Liabilities
Article 33 People's governments at or above the county level shall give incentives in accordance with relevant regulations to units and individuals that have made outstanding achievements in the energy conservation management of public institutions and the research, popularization and application of energy conservation science and technology.
Article 34 If a public institution commits any of the illegal acts specified in Article 37 of the Regulations on Energy Conservation in Public Institutions, the corresponding level of competent department of government offices administration shall, in conjunction with relevant departments, urge it to carry out rectification, and impose serious penalties in accordance with laws and regulations if the circumstances are serious.
Article 35 If a public institution fails to implement the national and provincial provisions on mandatory or priority procurement and purchases products and equipment included in the list of government procurement of energy-saving products and equipment, or purchases energy-using products and equipment eliminated explicitly by the state and the province, the government procurement supervision and administration department shall impose penalties in accordance with the provisions of Article 38 of the Regulations on Energy Conservation in Public Institutions.
Article 36 For other acts in violation of these Measures, if legal liabilities have been stipulated by laws and regulations, such provisions shall prevail.
Chapter VI Supplementary Provisions
Article 37 These Measures shall come into force on the date of issuance and shall be valid for 5 years.
